Terms of Service

1. Agreement to terms

Polished (the "Service") is operated by ExaHash Labs, LLC, a limited liability company organised under the laws of the State of Delaware, United States ("we", "us", "our"). The Service is available as a macOS menu bar app and as a Chrome extension.

By downloading, installing, or using the Service, you agree to these Terms of Service. If you do not agree, please do not use the Service.

2. What Polished does

Polished is an AI-powered text rewriter. You provide a draft of any text — a post, reply, email, message, or anything else — and the Service returns improved versions for you to choose from. Polished is offered through a free tier with usage limits and through paid plans (subscription and lifetime).

3. Eligibility and accounts

You must be at least 13 years old, or the minimum age required in your jurisdiction, to use Polished. You are responsible for keeping any license key, API key, or account credentials confidential and for all activity that occurs under your access.

4. License

Subject to these Terms and your timely payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Polished on devices you own or control, for your personal or internal business use.

You may not redistribute, sublicense, sell, rent, or lease the Service. You may not reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent such restriction is prohibited by applicable law.

5. Acceptable use

You agree not to use Polished to generate or distribute content that:

• Violates any applicable law or regulation.
• Infringes the intellectual property, privacy, or other rights of any third party.
• Is harassing, defamatory, obscene, hateful, or otherwise harmful.
• Impersonates another person or misrepresents your affiliation with anyone.
• Attempts to disrupt, overload, or compromise the Service or its underlying infrastructure.

You are solely responsible for the input you provide and the output you choose to use.

6. Your content

You retain all rights to the text you input into the Service and to the rewritten output you choose to use. We do not claim ownership of your content. Your text is processed in accordance with our Privacy Policy.

7. Third-party services

Polished relies on third-party providers, including OpenAI for language model processing and our payment processor for billing. Your use of the Service is also subject to the relevant terms of those providers. We are not responsible for the acts or omissions of any third-party provider.

8. Pricing, billing, and subscriptions

Paid plans are billed in advance on a recurring basis (monthly or yearly) or as a one-time lifetime purchase, as selected at checkout. Prices are displayed in your local currency where supported and may include applicable taxes.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can cancel or manage your subscription at any time through the billing portal linked from your purchase confirmation email.

We reserve the right to change pricing for new purchases or upcoming renewals. You will be notified in advance of any price change that affects your existing subscription.

9. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

10. Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the rewritten output will be accurate, suitable, or free of errors, and you should review any AI-generated content before using it.

11. Limitation of liability

To the maximum extent permitted by law, Polished and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you breach these Terms or if continued service becomes commercially impracticable. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will survive.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated through the Service or by email where reasonable. Continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be resolved in the state or federal courts located in Delaware, except where applicable consumer protection law gives you a right to bring proceedings in your country of residence.
